The Massachusetts Senate approved by a 28-10 vote an amendment to a budget bill that would, among other things, require businesses contracting with state agencies to confirm that their workers are authorized to be employed and barring employers that have been found to have hired unauthorized workers from doing business with state agencies.
Contractors will not be required to sign up for E-Verify. From the Bellingham Herald:
The Yakima City Council has voted against requiring city contractors use a federal program that checks a worker's eligibility to work in the United States.
In a 4-3 vote Tuesday, the council turned down a proposal to use the E-Verify system - a free, online program administered by the Department of Homeland Security.
Around the state, Clark, Whatcom and Pierce counties have implemented the federal program. The city of Lakewood also has approved E-Verify.
CASE HOLDS FAILING TO COMPLETE I-9'S CANNOT BE CORRECTED DURING 10 DAY CURE PERIOD
EOIR's Office of the Chief Administrative Hearing Officer has held that a restaurant could not fill out I-9s for the first time for employees during the 10 day period following an audit request by ICE and have the violation considered a mere technical violation. The failure is substantive and would be fined accordingly.
A lengthy court battle is over and next month voters in Freemont, Nebraska will get to vote on a broad immigration measure that includes a mandate for employers to use E-Verify.
UTAH GOVERNOR BACKS OFF PLANS TO MODIFY E-VERIFY MANDATE
In the wake of the Arizona immigration law's passage, Utah Republican Governor Gary Herbert has backed off plans to try and make an E-Verify employer mandate in his state voluntary. Herbert had planned to call a special session of the legislature, but has now scrapped this, according a report in the Salt Lake Tribune. Herbert was worried that a special session would lead to the opposite result of what was intended - that even tougher restrictions would be passed.
CBP COMMISSIONER IN HOT WATER OVER MISSING I-9 FORMS FOR NANNIES
Alan Bersin, the Commissioner of Customs and Border Protection is in trouble for not completing I-9 forms for 10 household workers since 1993. Bersin paid taxes on the employee's wages and there is no indication that the workers were illegally present.
More than 200 workers were fired from Pro's Ranch Market in Bakersfield, California after ICE conducted an I-9 audit at the company. 20 workers were able to save their jobs after they documented their authorization to be employed.
